This Resolution approves a comprehensive procedure for responding to cases of gender-based discrimination, gender-based violence, and sexual harassment. The Procedure applies to state authorities, the Armed Forces, law enforcement bodies, civil protection forces, the defense-industrial sector, local self-government bodies, and subordinated enterprises and institutions. It defines key concepts in line with national labor and anti-discrimination legislation and identifies the competent authorities involved in responding to such cases.
A central feature of the Procedure is the establishment of permanent commissions within each relevant body to examine complaints. These commissions operate based on principles of legality, impartiality, professionalism, and gender equality, and apply the concept of shifting the burden of proof from the complainant to the alleged perpetrator. The document regulates the composition, powers, and functioning of the commissions, including mandatory training for members, conflict-of-interest rules, procedures for collecting evidence, holding hearings (including remotely), and adopting conclusions. Clear timelines are set for reviewing complaints, with provisions for forwarding cases to law enforcement authorities when signs of administrative or criminal offenses are identified.
The Procedure also sets out detailed rules for submitting complaints, protecting confidentiality and personal data, informing complainants of their rights, and ensuring access to psychological, social, medical, and legal support. It obliges employers and public authorities to implement preventive measures, such as internal equality and non-discrimination policies, awareness-raising activities, confidential reporting channels, and gender audits. An annexed reporting form standardizes the collection of statistical data on complaints and outcomes, supporting monitoring and systemic prevention of gender-based discrimination and violence.
