Resolution No. 502 of the Cabinet of Ministers validating the Procedure for the use of water fund land.

This Procedure determines the mechanism for using water fund land, implementing a set of water protection measures, and conducting operational work to create favorable conditions for maintaining such land. The land of the water fund includes land occupied by: (a) seas, rivers, lakes, reservoirs, other waterbodies, swamps, as well as islands not covered by forests; (b) coastal protection strips along seas, rivers and around waterbodies, except for land occupied by forests; (c) hydraulic engineering, other water management structures and canals, as well as land allocated for diversion strips for them; (d) coastal strips of waterways; and (e) artificially created land plots within the water areas of sea ports. On the specified land, it is prohibited to conduct activities that negatively affect or may affect their condition or contradict their purpose, namely: (a) plowing of land (except for preparing soil for grassland and afforestation), as well as gardening and horticulture; (b) storage and application of pesticides and fertilizers; (c) establishment of summer camps for livestock; (d) construction of any structures (except for hydraulic, navigational, hydrometric and linear, as well as engineering and fortification structures, fences, border signs, border clearings, communications, outdoor sports grounds, physical culture and sports facilities that are not real estate), including recreation centers, summer cottages, garages and car parks; (d) arrangement of waste disposal sites, waste generation in the production process, manure storage facilities, cemeteries, cattle burial grounds, filtration fields, etc.; (e) washing and maintenance of vehicles and equipment; and (f) burning dry vegetation or its remains in violation of the procedure established by the Ministry of Environment. Water users who operate structures of artificial water bodies and water management systems are obliged to comply with the established operating modes, to carry out the reproduction, maintenance, protection and protection of water protection plantings on the banks of rivers, around lakes, reservoirs, in canal drainage areas in accordance with the requirements of the legislation. State control over the use and protection of water fund lands is carried out by the State Geocadastre and its territorial bodies, as well as by the executive bodies of village, settlement, and city councils in the event of their adoption.
