Abstract
The Act consolidates and modernizes the laws governing individual employment relationships in Uganda, applying to nearly all employees under a contract of service, with limited exceptions such as small family undertakings and members of the Uganda Peoples’ Defence Forces. It defines key terms, prohibits forced labour, discrimination, and sexual harassment, and promotes equality of opportunity, including equal pay for work of equal value. The Act also regulates the employment of children, restricts hazardous and night work, and extends protections to lawfully present migrant workers. It establishes an administrative framework under the Minister responsible for labour, including labour officers and the Labour Advisory Board, empowering them to inspect workplaces, settle disputes, enforce compliance, and prosecute offences. The Act comprehensively regulates employment relationships, covering contract formation and transfer, wages, recruitment, repatriation, and written employment particulars. It prescribes working conditions such as maximum hours, rest periods, leave entitlements, and statutory disciplinary procedures, including protections against unfair termination and summary dismissal.
