Abstract
This Act provides rules relative to mining and mineral and surface rights and related matters.
Prospecting, exploration and mining shall be carried out only under a prospecting licence, an exploration licence, a retention licence, a mining lease or a location licence. An application for a mineral right shall be made to the Commissioner for the Geological Survey and Mines Department, who is appointed under this Act. No prospecting or mining shall take place in a national park, a game reserve or a forest reserve. In every exploration licence or a mining lease, there shall be included a condition that the holder shall submit an environmental restoration plan. Grant of water rights shall be subject to provisions regarding inland waters or wetlands as contained in the Water Statute, 1995. Every holder of an exploration licence or a mining lease shall carry out an environmental impact assessment in accordance with provisions of the National Environment Statute, 1995 and shall carry out an annual environmental audit.

An Act to repeal and replace the Mining Act, Cap. 248, with a new legislation on mining and mineral development, which conforms, and otherwise gives effect, to the relevant provisions of the Constitution; to vest the ownership and control of all minerals in Uganda in the Government; to provide for the acquisition of mineral rights; and to provide for other related matters.
