Abstract
These Regulations provide further for various aspects of water law for which provisions was made in the Water Statute, 1995. The text consists of 29 regulations which are divided into 5 Parts: Preliminary (I); Water permits (II); Water Policy Committee (III); Drilling and construction permits (IV); Miscellaneous (V).
The first Part contains exclusively definitions, including a definition of drainage regime . The Director of the Water Development, may grant a water permit in the forms specified in the Fourth Schedule, except surface water permits and groundwater permits which shall be in forms C1 and C2 respectively. The Director, when considering an application for a permit, shall take into account factors specified in regulation 6. In addition to conditions specified in section 20 of the Water Statute, the Director may attach any of the conditions listed in regulation 7 to a permit. Regulation 7 makes also provision for the transfer of permits in the case of change of owner or occupier of premises in respect of which a permit exists. Regulation 10 concerns the registration of waterworks. Part III contains provisions relative to the Water Policy Committee established under section 9 of the Statute. In regulation 13 functions of the Committee are listed in addition to those already conferred by the Statute. Part IV makes provision in respect of rights to drill for groundwater and to establish boreholes. The Director may exempt certain boreholes from requirement to obtain a construction permit pursuant to regulation 16. Regulation 22 contains conditions, which shall be attached to a drilling permit. Part V provides, inter alia, for easements, water charges, the register of waterworks, and prescribes offences and penalties.
