Abstract
This Chapter provides for implementing the Treaty on Fisheries between the Governments of Certain Pacific Islands States and the Government of the United States signed in Port Moresby, Papua New Guinea on April 2, 1987.
The text consists of the following matters concerning: definitions; application to other Laws; Regulations; prohibited acts; exceptions; criminal offences; civil penalties; enforcement; licenses; reporting requirements and disclosure of information; closed area stowage requirements; arbitration; Disposition of fees, penalties, forfeitures, and other moneys.
Licences to fish in the Licensing area shall be issued by the individual or organization designated by the Pacific Island Parties ("the Administrator") (sect. 9). Provisions of section 9 deal also with fees for vessel licences. The Secretary of Commerce shall, at the request of a Pacific Island Party, fully investigate any alleged infringement on the Treaty involving a vessel of the U.S. Other provisions deal with matters such as reporting requirements, closed area stowage requirements, observers, arbitration, technical assistance and additional agreements.
