Abstract
This Part 229, implementing provisions of the Marine Mammals Protection Act of 1972, concerns authorisation for commercial fisheries, and the incidental taking of marine mammals, in order to reduce the incidental mortality or serious injury of marine mammals occurring in the course of commercial fishing operations. This Part defines the following relevant terms: American lobster; anchored gill-net; authorisation certificate; classification of commercial fishery based on the level of incidental mortality; fishing vessel; large and small mesh gill-net; mesh size; lobster management area; strategic stock of marine mammals. Matters covered by this Part concern: general and specific prohibitions; requirements for fishing vessels, including registration; monitoring of incidental mortalities and serious injuries; publication of list of fisheries; emergency regulations; penalties; confidential fisheries data; implementation of the Pacific offshore cetacean take reduction Plan; seasonal area specific gears.
