Abstract
This Part 296, implementing provisions of the Outer Continental Shelf Lands Act in its last amended version, provides for regulating the Fishermen’s Contingency Fund to compensate commercial fishermen for damage or loss caused by obstructions associated with oil and gas activities on the Outer Continental Shelf. The Part defines: outer continental shelf activities, including oil and gas exploration; commercial fishing vessel; fish, as all form of marine animals and plants, except for marine mammals, birds, and highly migratory species; fishing gear; resulting economic loss. Matters covered by this Part include: payments into the Fund; investments of the Fund; claims eligible for compensation, following damaging or loss of fishing gear; instructions and procedures for filing claims; burden of proof and presumption of causation; amount of award and compensation; judicial review.
