Abstract
This Agreement amends the Principal Agreement, as amended, which provides for the allocation of a portion of the total allowable catch of the United States to qualifying vessels of the PRC, access of vessels flying the flag of the PRC to the exclusive economic zone of the United States and the control over fishing operations and conduct of Chinese vessels and enforcement of United States fishing laws and regulations. The Principal Agreement of 1985 is amended, inter alia, by: Deleting in Article II, paragraph 1 "except highly migratory species of tuna"; giving a new definition of "fish" in article II; replacing the text of article III (application for fishing permits); adding a new paragraph at the end of article XII on cooperation in matters pertaining to implementation of U.N. General Assembly Resolution 46/215 on large scale Pelagic Driftnet Fishing, the conservation and management of anadromous species, and the conservation of pollock resources in the Bering Sea; replacing the text of Article XIII on consultations; replacing the text of article XIV concerning entry into U.S. ports by Chinese research and fishing vessels' by replacing Article XV on reciprocate fishing rights; replacing article XVI on prejudice of views with respect to jurisdictions and international rights and obligations of the respective Governments; and by inserting a new article which declares this Agreement applicable to the territories of the PRC and the U.S., its territories and possessions.
