Abstract
This Rule of the Environmental Protection Agency and the U.S. Army Corps of Engineers, for purposes of the Clean Water Act, 33 U.S.C. 1251 et. seq. and its implementing Regulations, and taking into account recent court rulings, defines the term "waters of the United States". The Rule also defines what is not to be considered as waters of the United States". The definitions also concern farmland and wetlands. By defining, defines the term "waters of the United States", this Rule will ensure protection for the nation s public health and aquatic resources and increase CWA program predictability and consistency by clarifying the scope of "waters of the United States" protected under the Act.
