Abstract
This Regulation defines the main tasks, functions, rights, responsibility and organizational basis for the activities of Inspectorate for Control of Mining and Geological Activities subordinated to State Committee on Geology and Mineral Resources. Inspectorate must ensure that all subsoil users comply with the legislative requirements, established rules and regulations for conducting work on geological exploration of mineral resources, mining, processing of mineral raw materials, water use and water consumption from underground sources, as well as the conditions for the use of subsoil plots established in licenses for the right to use subsoil plots. Compliance order issued by the Inspectorate and its regional inspections within their competence are mandatory for all bodies of state and economic management, local government bodies, legal entities and natural persons. In case of failure to comply with the instructions of the Inspectorate and its regional inspections’ officials of the aforesaid bodies and legal entities, as well as natural persons are liable in accordance with the acting legislation. The main tasks of the Inspectorate are: (a) implementation of state supervision over compliance with legal and regulatory requirements in the field of use and protection of subsoil in the process of geological exploration, extraction of minerals (including fresh, mineral, thermal and industrial groundwater), mineral processing, and geological and mine survey of mining operations; (b) control over the implementation of decisions and conclusions by subsoil users, prior approval by of mineral reserves deposits by State Commission on Mineral Reserves under State Committee on Geology and Mineral Resources; (c) introduction of advanced methodology for the prevention of offences, further development of interagency cooperation, widespread use in its activities of modern information and communication technologies; (d) in cases of detection of illegal mining, formalization of relevant documents, determination of the size of the applicable damage through surveying work; and (e) informing general public about identified offences and their consequences and developing proposals for improving law enforcement practice and legislation in this field.
