Resolution No. 126 of the Cabinet of Ministers validating the Regulation on the procedure for sale of trade and service facilities into private ownership, together with the land plots on which they are located, and transfer of land plots into lifetime inheritable ownership.

The Cabinet of Ministers, in order to expand the practice of selling commercial and service facilities into private ownership, together with the land plots on which they are located, as well as land plots into the lifelong inheritable possession of citizens for individual housing construction and personal subsidiary farming, decrees as follows: (a) land plots for lifelong inheritable ownership of citizens are sold at auctions within 0.04 hectares for individual housing construction and 0.06 hectares for smallholding (dehkan farming); and (b) as an experiment, land plots unused in the national economy, as well as land of unprofitable and low-profitable agricultural enterprises, are sold into the lifetime inheritable ownership of citizens on an auction and competitive basis within the limits of up to 5 hectares on irrigated land and up to 15 hectares on non-irrigated land. List of land categories that are not subject to transfer into private ownership and sale at auctions for lifelong inheritable ownership: (a) urban land (squares, streets, driveways, roads, embankments, parks, squares, boulevards, water protection zones, beaches and other); (b) lands of natural monuments, botanical gardens; (c) land for healthcare, historical and cultural purposes; (d) land provided for the use and protection of subsoil; (e) land contaminated with hazardous substances and susceptible to biogenic contamination; (f) land provided for by master plans for urban development, detailed planning projects and facility layouts, except for retail and service facilities; (g) land adjacent to highways; and (h) land alienated for power lines, cable lines and substations, heat, water and sewer lines and gas pipelines, national communication lines and structures on them, water management facilities.
