Resolution No. 146 of the Cabinet of Ministers “On measures to improve the procedure for providing land plots for urban planning activities and other non-agricultural needs.”

This Resolution validates the Regulation of the procedure for allotment of land plots for urban planning activities and other non-agricultural needs (Annex 1) and the Regulation on the procedure for compensation of losses of owners, users, tenants and owners of land plots, as well as losses of agricultural and forestry production (Annex 2). Regulation of the procedure for allotment of land plots for urban planning activities and other non-agricultural needs ensures: (a) use of land plots for construction in accordance with urban planning norms and rules, legislative requirements in the field of environmental protection, protection of historical and cultural heritage sites, protection of territories subject to special regulation of urban planning activities; (b) use of land plots strictly for their intended purpose; (c) compliance with the rights and legitimate interests of legal entities and individuals interested in obtaining land plots for the construction of enterprises, buildings and structures; (d) exercise of the rights of legal entities and individuals whose rights and legitimate interests may be violated in the process of allotment of land plots to other legal entities and individuals; (e) rational use of land; and (f) provision of land plots while maintaining the complexity, integrity and harmony of development in populated areas and the surrounding landscape. Regulation on the procedure for compensation of losses of owners, users, tenants and owners of land plots, as well as losses of agricultural and forestry production establishes that compensation for losses of owners, users, tenants, lessees and owners of land plots, including lost profits, as well as losses of agricultural and forestry production, is made by legal entities and individuals to whom the land plot is allotted, or whose activities cause restrictions on the rights to the land plot and deterioration in the quality of the land.
