Abstract
This Act, divided into eleven Parts and consisting of 54 articles, provides for all the purposes concerning the protection to breeders of new plant varieties, and applies to all plant genera and species including all fungi and algae. The Act covers the following matters: application for plant breeder's right; priority of foreign applications; establishment of the registrar of plant breeders’ rights, and definition of its powers; grant and revocation of plant breeders’ rights; conditions for defining a plant variety as new; varieties bred by two or more persons independently; payment of annual fees for plant breeder's rights; scope of plant breeders’ right, including: plant production and reproduction, offering plants for sale, import and export plant products, stock plant materials; extension of plant breeder's right to harvested material, and to essentially derived varieties; enforcement of plant breeder’s rights; application to the Court for granting a compulsory licence; registration of denomination; offences.
