Abstract
This Act, divided into 24 Parts and consisting of 192 Sections, provides for all the necessary actions and measures aimed at protecting and promoting trade marks. The Act concerns the following topics: authorised use of trade marks; registered trade mark; geographical indication; labels; registered owner of a mark; use of trade mark in relation to goods and to services; specific provisions for defining the origin of wine. Part II of the Act concerns: trade marks rights; categories of trade marks which may be registered; right to use the trade marks; limitation of rights for similar trade marks registered by different persons; trade mark as a sign describing articles; powers of authorised user of registered trade marks. Part III focuses on application for the registration of a mark; reasons for rejecting an application. Further Parts concern: divisional application for registration of part of trade mark; application for registration of series of trade marks; opposition to registration; trade mark containing or consisting of a false geographical indication; duty and actions of registrar and notification of registration; action by court concerning amendment and cancellation of registration.
The Act also focuses on the following matters: removal of Trade Mark from register for non-use, and related procedures; localised use of trade mark; certification of use of trade mark; infringement of trade marks; alteration of a mark and breach of certain restrictions; importation of goods infringing trade marks; general offences; false representation about intellectual property; use of collective trade marks; powers of courts and dispute settlement; use of trade marks for export trade.

An Act to repeal and replace Registration of United Kingdom Trade Marks Act (Chapter 113 of the Revised Laws 1990 Edition) and the Merchandise Marks Act (Chapter 106 of the Revised Laws 1990 Edition) and to provide for the promotion and protection of Trade Marks, and for related matters.
