Abstract
This Regulation is enacted for managing environmental incidents involving waste leakage, spillage, or dispersion. It classifies emergencies into four levels—facility, district, provincial, and national—based on severity and scope. The Regulation mandates proactive prevention, timely reporting, and coordinated response efforts led by designated authorities at each level. It emphasizes the “four on-the-spot” and “three readies” principles: leadership, resources, and logistics must be mobilized locally, with readiness for prevention, response, and recovery. Facilities must develop emergency response plans, conduct drills, and report incidents promptly. Higher-level authorities are responsible for verifying, announcing, and managing larger-scale emergencies.
The Regulation also provides for post-emergency environmental restoration, requiring polluters to bear the costs of cleanup and compensation. If the responsible party is unidentified, the state covers the expenses. Community involvement is encouraged through risk communication, participation in drills, and oversight of restoration efforts. Ministries and local governments are assigned specific roles in preparedness, response, and recovery, including public health protection, environmental monitoring, resource mobilization and enforcement.
