Decree 46/2026/NĐ-CP Elaboration of some articles and measures for organization of the implementation of the Law on Food Safety

This Decree is developed in accordance with the Law on Government Organization and the Law on Food Safety.
The Decree elaborates some Articles and provides guidance on implementation of some Articles of the Law of Food Safety. It defines scope, regulated entities, and key terms, and set up detailed rules for food safety across production, processing, import, export, and circulation.
The Decree details procedures for conformity declaration, certification of food safety compliance, and conditions for manufacturing and trading foods, including dietary supplements and food additives. It establishes rules on labeling (including genetically modified foods), advertising, and traceability, and sets requirements for laboratories serving state management. It further regulates inspection of imported and exported foods, including risk-based inspection methods and exemptions, and defines responsibilities of authorities and operators to ensure compliance and effective enforcement.
