Abstract
This Decree regulates the granting of fishery activity permits and defines the responsibilities of owners of foreign-fishing vessels engaged in fishery activities in Vietnam’s seas.
It consists of 23 articles divided into 6 Chapters. The Decree provides for conditions, procedures and competencies for granting and withdrawal of fishery activity permits of foreign-fishing vessels. The term of a granted permit will not exceed 12 months for aquatic resource-exploiting activities and 24 months for other fishery activities. Registration papers shall be issued on the basis of investment licences, scientific or cooperation contracts, or fishery contracts approved by competent authorities. The Decree provides for the rights and responsibilities of owners of foreign fishing vessels and it states the responsibilities of state management bodies. It includes the examination, control and handling of administrative violations, complaints and denunciations.
