Decree No. 42/2019/ND-CP regulating the Sanctioning Administrative Offences in the Field of Fisheries.

This Decree, consisting of 58 articles divided into four Chapters, establishes offences and penalties for administrative violations, all sanctioning forms and levels, remedial measures, competence to make records and sanction administrative violations according to different violation in the field of fisheries. Based on the nature and severity of violations, organizations and individuals may also be subject to one or more of the following additional sanctioning forms: a) Deprivation of the right to use permits and certificates for a definite term or suspension of operation for an established time; b) Confiscation of evidences and means used for illegal activities, such as: fishing vessels, fishing gears, electric shocking devices, banned substances, chemicals, banned chemicals, poisons, aquatic products and exploited aquatic products, certifications, authorizations, permits, etc. Chapter 2 deals with violation of regulations on protection of habitats of aquatic species.
