Abstract
The National Land Subdivision Policy is a cross-sectoral policy. The purposes of the policy are: (I) providing a clear purpose and guidelines by which subdivisions may be created and establishing the parameters of the administrative processes to achieve the purpose, (II) ensuring that the creation of subdivisions results in environmentally and socially sustainable development and an improved quality of life for residents with suitable standards of amenity, access, affordability, disaster risk reduction and health and safety, and (III) providing equity for all landowners and residents including present and future generations by taking into consideration cultural, economic, and environmental values attached to the land being subdivided.
Potable water will be provided by the applicant proposing to subdivide land to all lots within subdivisions, including agricultural, residential, commercial and industrial lots and public buildings. Detailed designs for the provision of water supply in a subdivision will be checked and approved by the appropriate water authorities to ensure that the construction and on-going management of water services will comply with the required standards prior to approval of the subdivision proposal. The applicant has the obligation to consult with the Department of Water Resources, apply for the appropriate water works and water use permits, and develop a drinking water safety and security plan. Water protection zones may be established and declared for the protection of water sources. The obligations of the applicant also include providing an adequate sanitary system for the collection and safe disposal of sewage and effluent wastewater for subdivisions of agricultural, residential, commercial and industrial lots and public buildings. Furthermore, surface drainage will be constructed in all lands intended to be subdivided in accordance with the requirements of the relevant local authority, and all specifications and requirements will be in accordance with the Drainage Act. Adequate drainage will be provided to the land to avoid the risk of flood or any other adverse environmental impacts. Moreover, the risks of flooding, erosion and landslides will be taken into consideration in all developments.
