Abstract
The Act consists of 31 sections divided into 6 Parts: Preliminary (I); Importation (II); Disease control (III); Plant control (IV); Administration (V); Miscellaneous provisions (VI).
In order to control the importation of plants, the Minister may appoint quarantine grounds under section 4 and ports of entry under section 5. The Minister may also prohibit or restrict the introduction of any plant material, disease, pest, soil, package pursuant to section 6. Plant material, etc., illegally introduced may be seized (sect. 8). Duties are imposed on occupiers of land for the control or eradication of plant diseases and pests (sect. 11). The Head of State may proclaim a plant disease emergency pursuant to section 12. Section 13 grants certain emergency powers to the Minister. If the Director of Agriculture, Forests and Fisheries is of the opinion that any disease, pest or residue of toxic chemical is present in any crop which a grower intends to pack and submit for export, and that the disease, pest or residue is present to such a degree that it would be impossible by grading and post-harvest treatment to eliminate the disease or pest from all infected plant material or to reduce the residue to a level which in his or her opinion is permissible, he or she may direct the grower not to submit the crop (sect. 15). Other provisions concern powers of enforcement and regulation making by the Head of State, notification of disease by the Director and some other matters of miscellaneous character.
