Energy Act No. 1 of 2009

The provisions of this Act shall apply to the activities of generation, transport, wholesale, distribution and consumption of electric power, as well as its import and export to and from the Republic of Yemen. The Act aims to: ensure electrical energy security; diversify environmental friendly sources of energy production, including renewable energy and reliable sources of sustainable energy; ensure the functional separation of the services of electric power; set and apply tariffs in a fair and transparent manner; ensure safety, continuity and quality of electricity service; regulate the relationship between consumers and licensees; encourage domestic and foreign investment in the electricity activities.
The Act is composed of 15 Chapters divided in 61 articles: Definitions and Scope (1); Purposes (2); Tasks and functions (3); Council for the Electricity Activities Regulation (4); Participation of the private sector and the introduction of competition in the electricity activities (5); Energy transfer system (6); Licensing system (7); Tariffs (8); Energy import and export (9); Land allocation and expropriation (10); Consumer rights and obligations (11); Rural Electricity (12); Sanctions (13); Judicial control in the electricity activities (14); and General and Transitional Provisions (15).
Chapter 3 indicates tasks and functions of the Ministry of Electricity and Energy which include: develop policies, plans and strategies; issue licenses; develop standards and technical regulations relating to quality, efficiency, continuity and reliability of service; collect, prepare and disseminate information, data and expectations regarding the request or use of electrical energy; bring the electrical service in rural areas, taking into account the least income consumers; encourage the development and uses of renewable energy sources. Tasks and functions of the Minister of Electricity and Energy are,on the other hand, mainly related to supervision, direction and control of all financial, administrative and technical work for the implementation of the ministry's activities and the government policy. Chapter 4 establishes the Council for the Electricity Activities Regulation chaired by the Minister of Electricity and Energy, and defines powers and duties. Chapter 6 indicates the procedures that should be taken by the Council to facilitate the energy transfer to the consumers. Chapter 7 gives rules for all the following activities: generation, transport, distribution or wholesale of energy, with the exempted cases. Chapter 12 establishes the General Authority for Rural Electricity which aims to implement the related National Plan program by guaranteeing electricity or other forms of electrical services, commercially, economically and environmentally sustainable, within the territory, with the final task of increasing the income of the population.
