‘At issue in this application is the lawfulness of the action taken by the three respondents in respect of the construction of certain earthworks undertaken by the third respondent on the bank of the Hartebeespoort Dam.’ It was held that EIAs can be done at the early stages of the project without having to start the whole project again. This was not the intention of the law regarding EIAs.
