Abstract
This Act, consisting of 47 articles, provides for setting essential norms and standards in the liquor industry, regulating the manufacture and wholesale distribution of liquor, organising the market and the retail sale of liquor, promoting the development of a sustainable and responsible liquor industry, involving public participation. The Act defines: beers; liquor; unsafe substances for human consumption; seller; supply; registration. Chapter 2 concerns regulation of manufacture and distribution of liquor; regulation of methylated spirits; prohibition of selling or supplying substances unsafe for human consumption; registered activities; prohibitions concerning employment in liquor industry, including a ban on the employment of persons under the age of 16; advertising restrictions; prohibition of supply of liquor or methylated spirits to minors.
Chapter 3 concerns measures for registration as manufacturer and distributor of liquors. Chapter 4 provides for designation of inspectors; definition of their functions and powers, including entry a premises and use of force; compliance notices. Chapter 5 specifies offences and penalties and imputation of criminal liability. Chapter 6 establishes the National Liquor Policy Council, defines its powers, including: development of a national Policy in respect of the liquor industry, consultation on legislation, norms and standards for the liquor industry. Chapter 7 provides for public health considerations; Ministerial power to issue Regulations and procedure to follow. Chapter 8 concerns general provisions. Attached Schedule provides for amendment of previous Acts, including the Liquor Products Act, no. 60 of 1989, and for measures concerning beer and traditional African beer production.
