Abstract
This By-law of the city of Cape Town concerns spatial development of the city area and regulates development matters such as water infrastructure, stormwater management, environmental protection, subdivisions of land and zoning. It also requires the city council to establish a Planning Tribunal for its municipal area. The City may, when approving an application for subdivision, require the applicant to establish an owners’ association for an area determined in the conditions of approval. If the City considers it necessary, a stormwater impact assessment and/or stormwater management plan may be required in conjunction with a site development plan, the extent of which shall be determined by the City depending on the magnitude of the development. Zoning can be for agricultural or environment protection purposes (this can be "overlay zoning" for specific management mechanisms).
Schedule 3 to this By-law contains the City of Cape Town development management scheme, which describes Cape Town’s zoning categories, base zonings and the development rules that apply to each zone, including primary and consent uses. All properties within the geographic area of the city are part of the integrated zoning scheme and are subject to land use provisions in the Scheme.
