Abstract
These Regulations, made Minister of Environmental Affairs, hereby under section 24(5)(ba), read with section 44(1)(a), of the National Environmental Management Act, 1998 lay down the procedure to be followed for the adoption of spatial tools and environmental management instruments to be used for the purposes of sections 24(2)(c) and (e) of the Act. Before adopting a spatial tool or environmental management instrument, the Minister or Member of the Executive Council (MEC) must ensure that the spatial tool or environmental management instrument indicates the purpose for which it was developed. Both the proposed adoption and the adoption of a spatial tool or environmental management instrument must be published in accordance with these Regulations. The Minister or the MEC, as the case may be, must give due consideration to all the comments received before making a decision on the adoption of the proposed spatial tool or environmental management instrument. The Minister must keep a register of all adopted spatial tool or environmental management instruments.
The Act specifies as environmental management instruments in section 24(5)(ba), among other things, environmental management frameworks and various environmental impact and risk assessments.
