Abstract
These Regulations of the Minister of Environmental Affairs, made under sections 48A and 86 of the National Environmental Management: Protected Areas Act, 2003, provides rules for the administration, conservation and management of the Childs Bank Marine Protected Area. The Marine Protected Area is entirely zoned as a single Controlled Zone in terms of the Act. In the zone access and use of vessels is restricted. No fishing may take place without a valid licence and only fish for large pelagic species by longline or tuna pole within the Marine Protected Area and subject to the quantity, fish size limits, allowable effort, closed seasons or bag limits is authorised. No person may undertake any activity listed in section 48A(1) of the Act in the Marine Protected Area unless authorised to do so in terms of these Regulations. Section 48 was inserted into the principal Act by the National Environmental Management: Protected Areas Amendment Act 2014. The Regulations set out general restrictions within the Marine Protected Area. Fishing gear onboard a vessel or in possession of any person that enters or is present in the Marine Protected Area must be stowed in the prescribed manner. A permit issued in terms of these Regulations may be suspended, cancelled or amended.
