Abstract
These Regulations of the Minister of Environmental Affairs, made under sections 48A and 86 of the National Environmental Management: Protected Areas Act, 2003, provides rules for the administration, conservation and management of the Namaqua Fossil Forest Marine Protected Area. The Marine Protected Area consists of one Controlled Zone. The Regulations set out general restrictions within the Marine Protected Area including the use of vessels and prohibits fishing in the Restricted Zone. No person may fish, or attempt to fish, in the Zone unless in possession of a valid fishing permit which authorizes such person to undertake linefishing. No person may collect broodstock in a Controlled Zone for undertaking aquaculture, without a permit from the Minister. Fishing gear on board of vessels entering the zone must be stowed in the prescribed manner. Fishing in a Controlled zone is restricted. No person shall in the Controlled Zone, fish or attempt to fish, from a vessel or the shore unless they are in possession of a valid fishing permit, and such fishing is subject to the species, quantity, fish size limits, allowable effort, closed seasons or bag limits authorised by such fishing permit. The Minister may suspend, cancel or amend a permit issued under these Regulations.
