Abstract
These Regulations of the Minister of Environmental Affairs, made under sections 48A and 86 of the National Environmental Management: Protected Areas Act, 2003, provide rules for the administration, conservation and management of the Orange Shelf Edge Marine Protected Area. The Marine Protected Area is zoned as one offhore Restricted Zone, one offshore Controlled Zone and one offshore Controlled-Pelagic Linefish Zone, in terms of the Act. As a general rule, no person may undertake any activity listed in section 48A(1) of the Act in the Marine Protected Area unless authorised in terms of these regulations. Section 48 was inserted into the principal Act by the National Environmental Management: Protected Areas Amendment Act 2014. The Regulations set out also other general restrictions within the Marine Protected Area. Restrictions are placed on the entry and use of vessels in the area. Fishing is prohibited in the Restricted Zone and all fishing gear shall be stowed as prescribed. Fishing in the Controlled and the Controlled-Pelagic Linefish zone requires a permit. Fishing is allowed only for specified species and prohibited at night. No person may fish for or be in possession of any shark or ray species (Elasmobranchii) within the Marine Protected Area. A permit issued in terms of these Regulations may be suspended, cancelled or amended.
