Abstract
These Regulations of the Minister of Environmental Affairs, made under sections 48A and 86 of the National Environmental Management: Protected Areas Act, 2003, provide rules for the administration, conservation and management of the Robben Island Marine Protected Area. The Marine Protected Area is zoned as on Restricted Zone, one inshore Controlled Zone and to offshore Controlled Zones in terms of the Act. No activity contemplated in terms of section 48A(1) of the Act may take place, except for scientific research purposes. Section 48(1) was inserted into the principal Act by the National Environmental Management: Protected Areas Amendment Act 2014. The Regulations set out general restrictions within the Marine Protected Area. Restrictions are placed on the entry and use of vessels in the zone. The management authority may in the management plan for the Marine Protected Area or in an internal rule, identify activities, except for those activities listed in section 48A(1) of the Act; which may be restricted, controlled, limited or prohibited and such areas must be indicated by demarcation buoys, demarcation markers or notice boards. No fishing may take place in the Restricted Zone. All fishing gear shall be stowed as prescribed. Fishing in the Controlled Zones requires a valid fishing permit. A permit issued in terms of these Regulations may be suspended, cancelled or amended.
