Abstract
These Regulations of the Minister of Environmental Affairs, made under sections 48A and 86 of the National Environmental Management: Protected Areas Act, 2003, provide rules for the administration, conservation and management of the Aliwal Shoal Marine Protected Area. The Marine Protected Area consists of an inshore and offshore area. The inshore area consists of two inshore Restricted Zones and two Inshore Controlled Zones. The offshore area consists of one offshore Controlled-Pelagic Linefish zone, two offshore Controlled Zones and four offshore Restricted Zones in terms of the Act. The Regulations prescribe general restrictions regarding activities and use of vessels within the Marine Protected Area. They also stipulate that no one may undertake any activity listed in section 48A(1) of the Act in the Marine Protected Area, unless authorised to do so in terms of these Regulations and introduce specific restrictions regarding each type of zone. These restrictions concern various types of fishing. No person may fish for any shark, or skateor ray species within the Marine Protected Area, except catch and release fishing for sharks from the shores. No person may undertake purse-seine and purse-net fishing within the Marine Protected Area.
