Abstract
These Regulations of the Minister of Environmental Affairs, made under sections 48A and 86 of the National Environmental Management: Protected Areas Act, 2003, provides rules for the administration, conservation and management of the Benguela Muds Marine, which is entirely zoned as one Controlled Zone in terms of the Act. In such zone fishing may take place only the conditions prescribed by these Regulations. In general, no person may undertake any activity listed in section 48A(1) of the Act, in the Marine Protected Area, unless authorised to do so in terms of these Regulations. Section 48 was inserted into the principal Act by the National Environmental Management: Protected Areas Amendment Act 2014. The Regulations set out general restrictions within the Marine Protected Area. Fishing gear onboard a vessel or in possession of any person that enters or is present in the Marine Protected Area who is not authorised to fish must be stowed in the prescribed manner. The Regulations also place restrictions on the use of vessels in the Zone.
When considering a permit for commercial or small scale fishing , the Minister must take into account, amongst others, (a) whether the species is listed as a threatened or protected species in terms of the Threatened or Protected Marine Species Lists and any prohibitions or restrictions therein.
