Abstract
This Notice - implementing the Biodiversity Act for what concerns the carrying out of certain restricted activities involving rhinoceros horn, or a part, product or derivative of such rhinoceros horn, belonging to the species black rhinoceros (Diceros bicornis bicornis, Diceros bicornis minor, Diceros bicornis michaeb) and white rhinoceros (Ceratotherium simum simum) - prohibits to powder, create derivatives from, or remove parts or layers from a rhinoceros horn. However, exceptions apply for activities such as inserting microchips or tracking devices, dehorning for management, or veterinary, or security purposes, collecting genetic samples, or when carried out by registered scientific institutions or the State for scientific or genetic profiling purposes. It is also forbidden to sell, give, donate, buy, or receive rhinoceros horn that has been powdered, had derivatives formed from it, or had parts removed, or any horn less than 5 cm in length. Exceptions to the prohibitions are set out in Article 4 stating that lawful owners may donate such horn to the Department or a registered scientific institution. Registered scientific institutions can receive or donate such horn for scientific purposes, or for genetic profiling as approved by the Director-General or by the Forensic Science Laboratory of the South African Police Service. The Department itself can also give, donate, receive, or accept such horn.
