Abstract
hese Regulations, made under section 25 (3) of the National Environmental Management Act no. 107 of 1998, and consisting of five chapters, provide for: outlining the prior informed consent (PIC) procedure for chemicals and pesticides, in compliance with the provisions of the Rotterdam Convention; implementing a decision-making process between countries on the import and export of chemicals and pesticides; promoting shared responsibility and cooperative efforts in the international movement of chemicals in order to protect human health, animal health and the environment. The Regulations apply to the banned or severely restricted chemicals and pesticides listed in the annexes and identified by various national pieces of legislation. Chapter 2 of the Regulations describes: general prohibition on import and export. Chapter 3 concerns: process for the notification of import and export of products and related decision-making. Chapter 4 concerns: record keeping of imported and exported products; reporting and submission of information. Chapter 5 provides for general matters, including: offences, penalties, repeal of previous Regulations.
