Abstract
These Regulations of the Minister of Water and Environmental Affairs, made under sections 53 and 55 of the National Environmental Management: Air Quality Act, 2004, regulate the management and phasing out of ozone-depleting substances. They prohibit, except for critical use (as defined), the production, import, export, use or placing on the market of any ozone-depleting substances and equipment or products that contain such substances. The Regulations also provide for the recovery of ozone-depleting substances, prohibit the stockpiling of ozone depleting substances listing in Schedule 1 to these Regulations and provide for reporting on importation or exportation of ozone depleting substances listed in Appendix A. A person who has a stockpile of listed ozone-depleting substance must submit an abatement plan as defined to the Director-General. A person who reclaims or destroys any ozone depleting substances must ensure that he substances are not released into the environment.
