Agriculture (Fertilisers and Feed) (Amendment) Act, 2010 (Act No. 32 of 2010).

This Act, consisting of 21 articles, introduces several key changes to the principal Act, primarily by narrowing its focus to fertilizers and strengthening its regulatory provisions. The main amendments are (i) the long title is revised to exclusively address fertilizers, dropping all mention of feed. Consequently, definitions for "farm feed," "livestock," and "sterilising plant" are deleted. The definition of "farming requisite" is updated to refer only to fertilizers or substances used in their manufacture, and the definition of "plant" is modified to exclude farm feed; (ii) the Minister is granted the power to approve laboratories for fertilizer testing under Section 19, and penalties are significantly increased; (iii) a significant change is made to Section 31, where a seller's statement on the composition of fertiliser is now considered a legally binding warranty. The Act also introduced a new general penalty clause in Section 48 for unspecified offences, which includes provisions for forfeiture and the revocation of a licence for repeat offenders.
