Abstract
These Regulations, comprising 37 articles, are designed to achieve the following objectives (i) promoting environmentally sound management of e-waste; (ii) safeguarding human health and the environment; (iii) ensuring adherence to established standards and practices in e-waste management in Zambia. Article 4 stipulates that any individual or entity intending to engage in activities involving e-waste, including generation, collection, export, storage, transportation, refurbishment, recycling, dismantling, import, or disposal, must obtain an e-waste management license from the Agency upon payment of a prescribed fee. The license, valid for three years and renewable, is governed by various procedural matters detailed in Part two, including renewal, suspension, revocation, and transfer. Part III delineates the obligations of stakeholders involved in e-waste management, encompassing generators, recyclers, refurbishers, importers, dismantlers, disposers, storers, and transporters. These stakeholders are required to adhere to specific protocols such as preventing and minimizing e-waste, ensuring proper segregation and reuse, utilizing licensed facilities, submitting regular reports to regulatory agencies, complying with guidelines and standards, and modifying any processes causing adverse environmental or health effects. Additionally, provisions mandate the provision of personal protective equipment to individuals handling e-waste and require the submission of notices of arrival or possession of e-waste to the Agency. The Regulations also establish an e-waste management register containing pertinent information, accessible for public inspection. Penalties are outlined for offenses such as improper e-waste disposal, failure to comply with licensing conditions, and providing false information to the Agency.
