Abstract
These Regulations are made in terms of section 40 of the Freedom of Information Act (Chapter 10:33). Part II establishes that public entities, public commercial entities or statutory offices shall cause to be published within six months of the commencement day of these Regulations or the establishment of the entity an initial statement of its organization, containing a series of information concerning a description of its functions, agencies, a description of the subjects on which the entity holds records and of services available to the public. The Part also requires those entities to designate information officers and provides for their functions and duties. Part III regulates requests for access to information, procedures on receipt of a request, transfers of request, third-party rights, notification of decision to grant access and right of appeal, and fees. Part IV concerns appeals to the Commission, it clarifies the role of the Secretary of the Commission and the hearing process. It also envisages the possibility to establish an appeals committee known as the Public Information Appeals Committee, for the expeditious determination of matters on appeal. Part V provides for offences, and Schedules contain forms.
