Abstract
These Regulations are framed in terms of section 64 read with section 50 of the Agricultural Finance Act [Chapter 18:02] to regulate areas or land proclaimed as irrigable. Part II of the Regulations requires written permission for any person to occupy or use land in an irrigable area. It lays down the responsibilities of the district irrigation engineer and their power to issue orders and notices. Part III establishes the Irrigation Development Fund, the monies receivable by such fund and its application. It also establishes an irrigation development agency in every district and province for the planning and implementation of irrigation activities within their respective jurisdiction.
Part IV provides for an irrigation levy that may be imposed through a statutory instrument for the purposes of these regulations. It also makes provisions in respect of beacons for defining limits, building fences and other structures, health and sanitation, firewood and timber. Part V contains powers of district irrigation engineer relating to farming operations including planning layout of fields, irrigation works, implementing disciplined farming, withholding of water etc. Part VI provides for keeping of animals in irrigable areas, control of stock and grazing. Part VII allows for exclusion and expulsion of persons from irrigable areas for reasons provided therein, the consequences of abandonment of crops and appeals. Part VIII lays down the offences and penalties.
