Abstract
This Act concerns a wide variety of matters regarding land tenure and use dealings with state land. It provides with respect to the exercise of the functions and powers, and administration of the Zimbabwe Land Commission, which is established by the Constitution. The Act consists of 67 sections divided into 11 Parts: Preliminary (I);Zimbabwe Land Commission and staff (II); Audits and investigations by Commission (III); Powers of Minister in relation to state land generally (IV); Land Settlement (V); Control and occupation of agricultural land (VI); Appellate and dispute settlement functions of Commission (VII); Register of Partially alienated land rights (VIII); statutory servitudes in relation to partially alienated state land (IX); Financial Provisions (X); General (XI).
The Commission shall have the jurisdiction to conduct comprehensive inspections and audits of agricultural land. Complaints and disputes regarding land shall be submitted to the Commission in accordance with this Act. The "appropriate Minister" may acquire land in addition to or alternatively to land acquisition carried out under the Land Acquisition Act, by way of exchange or by means of acceptance of gifts or bequests. Share-cropping agreements regarding land to which this Act applies shall be approved by the Minister. After consulting the Commission, the Minister may establish land settlement schemes for agricultural land. Land alienated by the Minister under this Act may, at any time, be retaken by the President.
The Act provides with respect to use of agricultural land. For this purpose, the Minister may request the Commission to carry out investigations and may give orders to holders or occupiers of farms. Part IX applies to the creation of statutory servitudes, including water servitudes as defined in the Water Act for the extraction or use of water. It sets out the basis for such servitudes, the method of creating, varying or cancelling statutory servitudes and powers of Commission in regard to disputes in connection with proposed statutory servitudes. Servitudes must be registered.

An Act to provide for the Zimbabwe Land Commission established by section 296 of the Constitution; to provide for the acquisition of State land and the disposal of State land; to provide for the settlement of persons on, and the alienation of, agricultural land; to provide for the control of the subdivision and lease of land for farming or other purposes; to provide for limiting of the number of pieces of land that may be owned by any person and the sizes of such land; to repeal the Agricultural Land Settlement Act [Chapter 20:01] and the Rural Land Act [Chapter 20:18]; to amend the Land Acquisition Act [Chapter 20]; and to provide for matters connected with or incidental to the foregoing.
