Abstract
The Act provides for the establishment of Zimbabwe National Water Authority as a body corporate and the establishment of a Water Fund, defines the functions of the Authority and the objects of the Fund, provides for functioning and financing of the Authority and its internal structure, and allows the Minister of Rural Resources and Water Development to impose a water levy on holders of permits under the Water Act.
The Act consists of 59 sections which are divided into 7 Parts: Preliminary (I); Zimbabwe National Water Authority (II); Issue of shares and securities (III); Financial provisions relating to the Authority (IV); Water Fund (V); General (VI); repeal, transitional provisions and savings (VII).
The Authority shall be directed and controlled by a board created pursuant to section 4. The Authority shall advise the Minister on matters relating to water, participate in water resources development planning, exploit, conserve and manage water resources, promote efficient, equitable and sustainable allocation and distribution of water resources, assist local authorities and control catchment councils with regard to discharge of their functions under specified legislation, notably the Water Act, operate and maintain water works, and carry out other functions outlined in section 5. Powers of the Authority are defined in section 6. For the better exercise of its functions, the Board may establish one or more committees pursuant to section 12. Shares of the Authority shall be allotted to the State and may in part also be allotted to persons other that the State in accordance with section 22. The Authority may establish charges for water supply, disposal of water, drilling of boreholes, etc. pursuant to section 30.
The Water Fund shall be managed and controlled by the Minister, who shall act as a trustee (sect. 39). Water levies imposed by the Minister under section 41 shall be remitted to the Fund. The Fund shall be administered by the Authority on behalf of the Minister (sect. 42). The Fund shall finance functions of the Authority other than commercial functions (sect. 43).
