Federal Law No.9 of 2013 on Plant Genetic Resources for Food and Agriculture.

This Law consisting of 22 articles implements the International Treaty on Plant Genetic Resources for Food and Agriculture. It aims at (i) protecting and conserving plant genetic resources for food and agriculture, reducing their depletion and sustainable use, and regulating access and handling for agriculture and food security; (ii) ensuring that the benefits arising from the utilization of plant genetic resources for food and agriculture are shared equitably and equitably, in accordance with the provisions of the Treaty; (iii) ensuring the participation of all stakeholders in the implementation of programs and activities related to the protection and maintenance of plant genetic resources for food and agriculture; (iv) promoting scientific research activities on plant genetic resources for food and agriculture in coordination with stakeholders; (v) creating an inventory, compilation, classification and documentation of plant genetic resources for food and agriculture in the country; and (vi) creating a documentation of traditional knowledge and practices together with innovations associated with plant genetic resources for food and agriculture. Responsible body for the implementation on the Law is the Ministry of Environment and Water, in which shall be established also a Gene Bank for Plant Genetic Resources for Food and Agriculture. It is prohibited to remove any plant genetic resources for food and agriculture beyond the borders of the State without a valid transfer agreement (art.6). Access to plant genetic resources for food and agriculture shall be permitted only with the consent of the competent administration, whether in their natural habitat or outside (art.7). The plant genetic resources for food and agriculture covered by the Multilateral System in Annex I of the Treaty, whether in-situ or ex-situ, are subject to the terms and conditions of this Law (art.8).
