Ministerial Resolution No. 100 of 1993 issuing the Implementing Regulation of Federal Law No. 38 of 1992 on the creation of nurseries and regulating the production, importation and circulation of layers.

This Resolution is composed of 24 articles. Article 1 deals with terms and definitions. Articles 2 and 3 define the basis, conditions and requirements for the creation of nurseries and sale places. Article 4 illustrates the kinds, species and requirements for layers. Article 5 establishes the requirements, conditions and the description of the different layers in the UAE (citrus, palm, mango, afforestation layers, ornamental plants, vegetables). Article 6 has to do with the conditions and requirements for the production and advertising of layers. Article 7 prescribes conditions and requirements for layer breeding. Articles 8-10 deal with registers and control of nurseries, employees assigned for the control and in case of the confiscation of layers incompatible with the provisions of Law No. 38 and this Implementing Regulation. Article 11 lays down the conditions and requirements for the importation of layers. The validity of the importation’s licences shall be one year from the date of its issuance (art. 12). Every imported plant consignment shall be enclosed with a sanitary certificate issued by the concerned Authority of the country of origin (art. 13). The plant consignments, planting materials and seeds shall be submitted to the control of quarantine centres within 24 hours from the arrival of the consignment (art. 14). The creation of nurseries shall be carried out after a previous authorization of the Ministry of Agriculture and Fish Resources (art. 18). Article 20 lists the necessary data and information for the application. All persons residing in the UAE having an activity related to Federal Law No. 38 of 1992 shall settle their position within 6 months from the date of entry into force of this Law (art. 23)
