Abstract
These Regulations are divided into 7 Parts i.e.: Preliminary (1); Fisheries Advisory Committee (2); Foreign Fishing Vessels (3); Local Fishing Licences (4); Fish Processing Establishment Licences (5); Fishery Conservation Measures (6); Miscellaneous Provisions (7); and 8 Schedules, i.e.: Application Form for a Foreign Fishing Licence (1); Foreign Fishing Licence (2); Application Form for a Local Fishing Vessel Licence (3); Local Fishing Licence (4); Fees for Local Fishing Vessel Licences (5); Application Form for Fish Processing Establishment Licence (6); Fish Processing Establishment Licence (7); Marking (8).
The text establishes a Fisheries Advisory Committee (sec.3-1), determines its composition (sect. 3-2) and defines its functions (sect. 4). Under Part III, foreign fishing operations are subject to authorisation. No licence shall be issued to a foreign fishing vessel unless the applicant produces a certificate that the vessel is registered in the Regional Register (sect. 8). Section 9 sets out general conditions applying to foreign fishing vessel and including the interdiction of transhipping fish from or onto the vessel, the display of identification markings, the maintenance of a logbook recording daily catch, the taking of observers on board. In addition, a licence shall not be issued in respect of a foreign fishing vessel unless a local representative authorized to act on behalf of the master, owner or charterer is appointed (sect. 10). Part IV, on local fishing licences, provides for application form, fees, refusal of licence and general conditions attached to licence. Operation of a fish-processing establishment is subject to authorization. Specific fishery conservation measures with regard to lobster, turtle, conch, and aquarium fish are spelled out in Part VI. Section 29 of Part VII stipulates that any person contravening any of the provisions of the regulations is guilty of an offence and is liable on summary conviction to a fine of $5,000 or to imprisonment of twelve months.
