Abstract
This Law aims to: 1. To ensure a high level of protection of human health and environment in general through determining the limitation of production, placing on the market and use of chemicals, use of chemicals in articles, import and export of certain chemicals; 2. To ensure the free movement of chemicals and other goods, as well as to increase competition and innovation; 3. To promote alternative methods for assessing the risks of chemicals; 4. To ensure that risks from hazardous substances cause very high concern are properly controlled and that these substances are replaced properly progressive from less dangerous substances or apply technologies where the alternatives of suitable replacements are economically and technically available; 5. To harmonize the legislation on chemicals in the Republic of Albania with the System of Globally Harmonized Classification and Labelling of Chemicals; 6. To establish a mandatory system for classification, labelling, packaging and Chemical Safety Data Sheet; 7. To implement the Rotterdam Convention to which Albania is a party; 8. To create and maintain the register of chemicals that are placed on the domestic market or are produced to be exported outside the Republic of Albania; 9. To ensure the deposit and safe storage of chemicals placed on the market, in compliance with the requirements and provisions of this Law.
The purpose of this Law is: 1. Determination of obligations to producers, importers and users to classify chemicals they place on the market and to provide the Safety Data Sheet for chemicals; 2. Determination of obligations to all suppliers for labelling and packaging chemicals; 3. Determination of obligations to exporters and importers of chemicals, which are subject to prior import consent and export notification provisions; 4. Regulation of production, placing on the market, use and export of chemicals dangerous; 5. Determination of the obligations and procedures for the creation and maintenance of the registry of chemicals that are placed in the domestic market or that are produced to be exported abroad Republic of Albania. This Law applies, regardless of special legislation, to: a) putting biocidal products and plant protection products on the market; b) minimum requirements for safety and health at work and for the protection of employees from risks related to exposure to chemical agents, as well as carcinogenic substances or mutagens at work; c) the environment, which includes the legislation in force for environmental permits and pollution limit values of air; d) integrated water management; e) integrated waste management.
The text is divided into thirteen main thematic Chapters and a total of 45 articles. Titles of these Chapters are as follows: I. General provisions; II. Competent state authorities; III. Classification, labelling and packaging; IV. Chemical safety assessment, safety data sheets and other requirements for suppliers; V. Substances with very high hazards; VI. Restrictions on the manufacture, placing on the market and use of certain chemicals and certain dangerous articles; VII. Export and import of hazardous substances; VIII. Provisions in support of chemical management; IX. Reporting, access to information and international cooperation; X. Inspection and supervision; XI. Offenses; XII. Financial obligations; and XIII. Transitional and final provisions.
This text is also partially aligned with: Regulation (EC) No. 1907/2006 of the European Parliament and of the Council concerning the Registration, Evaluation, Authorization and Restriction of Chemicals (REACH), establishing a European Chemicals Agency, amending Directive 1999/45/EC and repealing Council Regulation (EEC) No. 793/93 and Commission Regulation (EC) No. 1488/94 as well as Council Directive 76/769/EEC and Commission Directives 91/155/EEC, 93/67/EEC, 93/105/EC and 2000/21/EC; and Regulation (EC) No. 1272/2008 of the European Parliament and of the Council on classification, labelling and packaging of substances and mixtures, amending and repealing Directives 67/548/EEC and 1999/45/EC, and amending Regulation (EC) No 1907/2006.
