Regulation No. 69 date 7.2.2018 approving the conditions and the rules of procedure for the selection of the gas suppliers of last resort.

This Regulation approves the terms & conditions and the rules of procedure for the selection of gas suppliers of last resort. The terms and conditions aim at guaranteeing effective, transparent, and non-discriminatory competition between the interested applicants. Accordingly, the line ministry after consulting the Energy Regulatory Authority (ERA) publishes the notification for the opening of the selection procedures at the Public Procurement Bulletin. ERA drafts the operational rules for the supplier of last resort and approves the methodology of tariff calculation based on the stipulations of Law 102/2015 on the natural gas sector. Further, the Regulations lays down the requirements regarding the content of the application file. The supplier selection is conducted by a special assessment committee established by the order of the line Minister and composed of seven expert members. The committee decision is then submitted to the Minister who's responsible for moving it along for the approval of the Council of Ministers. Further, the regulation stipulates the terms & conditions for the termination of the supplier's of last resort operations. The Ministry of Infrastructure and Energy is the responsible authority for the Regulation implementation.
