Government Decision No. 702 validating the procedure for transferring water use permit to other persons in accordance with contract.

This Government Decision regulates the process of transferring right or a part of it to another person, including selling it, as well as the relations concerning that process. The right granted by the water use permit can be transferred in the following ways: (a) by a written contract signed by the parties; (b) in order of succession; and (c) in order of inheritance. The transfer of the right granted by the water use permit, except for succession and inheritance, is carried out by a written contract. The transfer of the right granted by the water use permit in the order of succession is formalized in the Ministry of Environment, in accordance with the law, on the basis of the copy of the deed of transfer or the balance sheet submitted by the successor. The transfer of the right granted by the water use permit in the manner of inheritance is formalized in the Ministry of Environment, in accordance with the law, on the basis of a copy of the certificate of the right of inheritance presented by the heir. The transferee of the right granted by the water use permit, inserted in the state water register, for registration within 10 days from the date of formalizing the documents regarding the transfer of that right, in the Ministry of Environment, otherwise the transfer of the right granted by the water use permit is considered invalid.
