Law No. HO-128-N amending Water Code of the Republic of Armenia.

Article 78 shall be amended to add the following wording: “Article 78. Payment for the acquisition of water use rights and use of the water system. State duty shall be paid for the acquisition of the rights to water use and the use of the water system in the manner and amount established by the Law of the Republic of Armenia "On State Duty". The authorized body shall duly notify the applicant within one working day after the decision to issue a permit, prolong the permit, and re-issue the permit. The applicant shall be notified of the consequences provided for in this Article. The applicant shall be obliged to pay the state fee for the provision of the service established by this Article not later than within 5 working days after the proper notification of the approval of the application for the issuance of permit, prolongation of the validity of the permit, reissuance of the permit. The applicant may not submit to the authorized body a document certifying the payment of the state fee. In case of failure of the applicant to provide a document certifying the payment of the state fee, the authorized body, after making a decision to grant the application for the issuance of a permit, renewal of the permit, and reissuance of the permit, shall, through the treasury online management system or the state electronic payment system, certify the payment of the state fee within the time limit established by this Article and duly issue or send to the applicant the permit, the permit with an extended term, the renewed permit and the decisions related thereto. The permit, the permit with extended term, the re-issued permit shall come into effect after the proper notification of the decision on granting the permit, the permit with extended term, the re-issued permit, and in case of payment of the state duty by the applicant after the proper notification of the decision on granting the permit, the permit with extended term, the re-issued permit - from the date of payment of the state duty. In case of non-payment of the state fee by the applicant within the term established by Item 2 of this Article, the corresponding decision taken by the authorized body shall be considered null and void”.
