Abstract
The purpose of this Federal Act is to define the requirements for practicing the veterinary profession in Austria on a freelance basis or in an employment relationship, and the conditions that veterinarians must comply with in the exercise of their profession. This Federal Act does not affect: the powers of doctors; activities in the field of scientific and didactic research as well as in state research institutes; other persons authorized for ante-mortem meat inspection and for artificial insemination of domestic animals; activities regulated by commercial legislation; the power to conduct animal experiments.
It is divided into 7 sections and 44 articles attached with 1 Annex. Article 2 gives definitions of important terms, including: Official veterinarians are those employed by the authorities of the State administration and are entrusted with the enforcement of veterinary services or animal welfare and have to perform official duties; Livestock, which includes animals of species intended for the production of food or other products for human use, with the exception of equines that have been declared not to be intended for slaughter for human consumption.
Article 4 specifies that veterinarians may carry out the following activities: examination of animals, diagnosis and treatment; veterinary preventive measures against diseases of animals, in particular vaccinations; surgical interventions on animals; injection, transfusion, infusion, instillation and blood draw in animals; prescribing medicinal products for use on animals; ante-mortem and post-mortem inspection; issuance of veterinary certificates and reports; artificial insemination of pets.
Concerning the exercise of the profession, the Act specifies in detail which requirements veterinarians must have, provides for circumstances of its suspension and expiration, specifies the role and the involvement of auxiliary persons and voluntary veterinary service.
In order to promote animal welfare, the Act authorizes veterinarians to own, store and carry medicines for direct use and small quantities of ready-to-use veterinary medicinal products, with the exception of immunological veterinary medicinal products.
Fines are imposed on individual or legal persons (veterinary associations) in case of misconduct or administrative offences.
Entry into force notes
The Act enters retroactively into force on June 1, 2021.
