Abstract
This Federal Act implements the Commission Regulation (EU) n. 528/2012 (last amended by Regulation n. 334/2014) and all other related implementing acts of the European Union concerning the use of biocidal products and its availability on the market.
The Federal Act consists of 26 articles, divided into six sections. First section provides for general provisions and for biocidal products’ availability on the market. Second section concerns responsible authorities, procedures, information, application for permits, fees and report. Third section provides for classification, labelling, packaging, safety instructions and regulatory authorization to issue bans and restrictions. Fourth section establishes monitoring and supervisory powers, as well as preliminary coercive and security measures in case of imminent danger to the health of people or animals or to the environment caused by biocidal products. Fifth section indicates penalties and criminal provisions. Sixth and final section concerns transitional and final provisions.
